Executive Order 13526 (not Title 10 directly) defines who may classify originally: President/VP, agency heads, delegated officials, only over government-owned or -controlled information. SAPs can be created only by a short list of secretaries/DNI. Contractors hold classified material as custodians under government control via security agreements.
