The FY1993 Intelligence Authorization Act (P.L. 102-496, 1992) made DOE's OICI a full member of the 18-agency IC; the OICI director is appointed by the Energy Secretary WITH THE DNI'S CONCURRENCE.
The second and third DOE<->DNI couplings (institutional + personnel) on top of TFNI (info-level). Together the three couplings make the born-secret complex the strongest POSSIBLE concealment locus in US law. Documented statute + governance; possibility, not proof.
