July 2023 Senate amendment (S.Amdt.797 to FY2024 NDAA) modeled on the JFK Records Act; created a NARA records collection, an independent Records Review Board, and federal eminent domain over recovered tech/biologics.

Introduced by Schumer and Rounds with Rubio, Gillibrand, Young, and Heinrich, it set a presumption of disclosure with a 25-year backstop and presidential override. The board would be nine presidentially appointed, Senate-confirmed members with subpoena power, barred from prior UAP-program ties. The eminent-domain clause targeted recovered material held by private contractors. The Senate passed its NDAA with the language on July 27, 2023 before conference gutted it.
