A waived USAP is an unacknowledged SAP whose annual congressional reporting requirement the Secretary of Defense has waived under 10 U.S.C. 119(a). Its existence is deniable to nearly everyone. Only the Gang of Eight is supposed to be briefed, often orally. It is the structure Grusch points to as the legal shell for a hidden program.
